Restocking fee for defective unit?

I received my N7 yesterday and like others have experienced the bezel is not tightly connected to the device. The device also is not recognized by any pc or mac when I plug it in. I want to return the N7 for a refund but do NOT want a replacement because I'd rather just wait for the next generation. Does anyone know if I will have to pay the 15% restocking fee? I would assume it's covered because the screen is defective. Thanks.
 
Google play. Their policy isn't clear to me if the restocking fee applies to defective units that are NOT being replaced (I simply just want my money back).

I guess I'm about to find out soon myself. But I'm going to assume they won't charge a restocking fee. At least I'm going to ask them not to. Of course I imagine they'll need to look at the tablet before making any guarantees to make sure it doesn't look like I threw it out the window of a speeding car.
