Return/Exchange Question

I got a Droid Incredible back in May and it was stolen a week or so ago and I received a like-new replacement just this week. I have been through multiple chargers and batteries until it was determined the phone internally was defective. Since the 30 day warranty applies to like new replacements such as the next Incredible they are shipping me Monday, would I be able to exchange this for the Droid X? I am just fed up with the Incredible, while it is a great phone I can't deal with it anymore. I realize a restocking fee would be involved but any information is appreciated.
 
No, your 30day warranty only applies to your initial purchase (so it would've ended in June) and if your phone was stolen, it means you got an insurance replacement, so I don't think it would be honored back then either.

When you get a replacement, you have a certain amount of time to determine it's not defective and they will replace it without another deductible. Unfourtunatly, the "Worry Free Guarantee" (what you want) doesn't apply to insurance claims.
 
Asurion (insurance) phones have a 90 day manufactor warranty. This means you can replace the device for any defects other than pbysical and water damage. And no, they will not replace it with it with a differant model unless asurion is out of the current one in use, which in your case would be the Incredible.

In the past Verizon would offer a different model after three (warranty, not insurance, claims). Verizon no longer offers this because of too many people abuseing the system.
