Can we flash without factory resetting if we are running the previous stock rooted ROM?

It would be highly recommended to wipe as this contains a brand new kernel etc.

Just do a nandroid backup of your current setup, then wipe and flash this guy. If you use titanium backup you can restore your apps that way..

After flashing this after a full wipe I'm missing a bunch of apps from the market. Any way to fix this?

Are you saying protected apps arent showing in the market after flashing this? Meaning some stuff shows up fine but others, i cant think of an example off hand, arent showing up at all?

Apps are MISSING from the actual market, meaning they no longer exist in he market.

Probably has to do with the fact they changed the footprint probably won't see all apps till they allow the new footprint into the market.

Beezy's answer FTW. This happens a lot when OTA's or ROMs leak out from companies. You are running it on your phone but the market has not been updated to recognize this new firmware so anything thats protected won't show up. When the company (Sprint/HTC) officially release it, a little "magic" switch gets flipped and the apps start showing back up. The problem though is your guess is good as anyones as to when this will officially be available.
