I'm no expert nor do I claim to be one, but it would seem to me that it would be far easier to provide an update or new OS to a "pure google" phone with vanilla android versus an HTC that has to deal with Sense UI etc. Just my .02 - take it for what it's worth.

"Coming months" was only referenced with regard to other AT&T phones, not the HTC Vivid.

Did you not read the article?! The Vivid HAS the update already. The OTHER phones are coming soon. (In fact on this site - android central - you can go to the vivid subforum and see people who already have the OTA update to ICS!

Making the case for "false advertising" would involve proving intent (or lack thereof). They can still rightfully claim they intended for the Nexus to get first updates, but snags and hitches and bumps caused unforeseen delays. Poof...there goes your argument.

Right now, aside from the weird random rebooting that happens every now and then, my phone works fine on GB. I'll be happy to get ICS, but I'm not desperate enough to screw around with it by unlocking, etc.

I will, however, probably not look for the Nexus branding when considering my next phone.

I agree. I'm not going to sue anyone for false advertising but the promise of first updates was definitely a factor in choosing this phone over others, so yes, I'm going to be a bit upset at Google for it.

I was never told it would be the first to receive updates. Nor was it advertised anywhere (that I saw) in the sprint store. The selling point my sprint store used was that it had no sprint bloat ware.

Oh really? The sprint store I went to (lakewood, CA) had that advertised on the little plastic plaque thingy. I was intending to get an iPhone 4, but they soon told me that I would have to pay an additional $99 for insurance w/ no replacement, so they took me over to android. I went looking over at the E4GT but my rep persuaded me to get the NS4G because of the bloatless software, first to get upgrades, and it was cheaper.

My next phone will definitely be a GSIII

Retentions =/= lawsuit. But if I recall, they did advertise it as getting the latest updates.

Yeah.. I love my Nexus S and have been pretty happy Google, but never again will I fall for that line of bull (first to receive updates) crap when choosing my next phone and it DID weigh in heavily on my decision to buy it. I though it was a great idea and feature.... so much for that.

Your still forgetting Nexus is a pure vanilla experience with no bloat ware. Nexus isn't going anywhere.

This has been shown before that Google's website said the Nexus S would be the first to receive OS updates (since taken down since it's now Galaxy Nexus) and from Sprint's own page:

Who will love it: Android-powered players who want the latest Google Apps? and OS updates as soon as humanly possible.
