Is it tied to the google account or the phone? Example, If I buy a Pixel off swappa that was activated already.
 
Phone since they want photos off the Pixel getting it -- not the entire account getting free photos/videos for all other Android phones. Google Photos can tell when the photos are backed up from the Pixel.
 
An example is below. Normally it says "Unlimited" via the compression or "Full Resolution" but since it sees I am on a Pixel it forces Full Resolution.

Kind of a combination. It gives unlimited uploads to the account that is currently on the phone. If the phone is sold or the account is switched, it gives unlimited uploads to that new account on the phone.

so if i try to upload photos from a mac with the same account it wont count?

No. It has to be uploaded from the Pixel. My understanding is they can tell what photos are taken with the Pixel to count for the free storage.

Correct. It doesn't just whitelist your whole account, it only gives you free full-res uploads from the Pixel. Uploads from another phone or the computer will count toward your Drive storage quota if you're uploading full res.

Phone bc in the settings it switches to "uploading full resolution photos from your pixel phone" and it doesn't let me change it to just the high quality unlimited or the high res that uses your storage like on my nexus 6p. I tried putting the sim card back on my nexus and it knows that it's not a pixel so goes back to high quality unlimited it does know.
