They lost the preliminary injunction so there is nothing wrong with the GS3 shipping yet. The ban was for the Galaxy Nexus. If Apple where to try again against the GS3, at best they would be able to do is get a ban on future sales since the legal process would take too long just to get a ban for preorders that are already going to be shipping out on the 9th. Come tomorrow, the 9th is only a week away. Apple and their legal department would have to come up with new grounds to get it ban, submit it to the court, have them review it, then have a hearing, then maybe get a ban. I don't think that will take a week.
In other words, don't worry. I don't think anything will happen to the initial round of preorders. I can't speak for those waiting a couple weeks to pick one up though. Besides, Apple getting a ban on the Galaxy Nexus brings up a very interesting point. Apple has always gone after phones from HTC or Samsung but never after a Google branded device. Now that they have, Good might (I say might not will) step in for the first time considering it directly effects their product that they brand with the Google name. I can only speculate but all we can do now is sit and wait to see what happens.
