When does WiFi not count towards data?

In many places I usually go where free WiFi is offered I have found that part of the time I am on the Web I am getting shown as using Data.
Two questions
1) If the WiFi icon at the top if the screen is gray does that mean I AM using data if I get on the Web but not being charged data when the color changes to blue?
2) If the app I use shows I AM connected to internet but the company's user agreement screen has not cone on yet will that mean I probably am being charged for data?

1. According to Google, grey connection icons mean that there is no connection with the Google servers, so for the most part, a grey wifi icon means no data is being transmitted over wifi. Therefore, if your 3G/4G radio is on, data is likely being transmitted preferentially that way. However, I think it's still possible in some instances for some data to be transmitted over wifi even if the icon is grey--this might happen if there's an issue with the Google servers, but the device is still able to access non-Google sites. In this case, I'm not sure if any 3G/4G is being used at the same time.

2. That's a good question--I can't remember if I've experienced this before. I'll have to try it next time I'm at a Starbucks or something.
 
Easy answer to 1 and 2...if the icon is blue, that is the connection data is being transfered by. Therefore, if the user agreement screen for public WiFi has not been dealt with, the WiFi icon will still be gray.

Some public wifi make you agree to terms and conditions. So you may have to open chrome to do so. If you do not then you are not fully connected.

You are right. This is what I have found out to be the case in the last two weeks. WIth my current phone (Samsung S3) for some reason the terms.agreements page which Has to come up before being fully connected,will not come up until I hit the Chrome icon first. If I try to log on with another app, it just doesn't bring up the right screen. Frustrating at first but now I am used to it.
