Why is the back button on my note 4 so unresponsive?

I recently purchased a note 4, and the second I booted it up and set it up, I knew something didn't feel right.. the button to the left of the home button works perfectly and never becomes unresponsive, but the back button (NOT the home button) is sometimes so unresponsive it won't work until I press it a dozen times..

Sounds like a manufacturing defect going to have to take it back
