Will my plan be "grandfathered" if I do an upgrade on a 2nd line?

My wife still has a Motorola Devour and it's giving her all types of problems but is out of the warranty period. I'd like to upgrade her to a better phone (preferably one that supports CyanogenMod), but am concerned that if we do the upgrade and sign a new contract that she will be subject to the new data caps and other provisions of the new plans. Can anyone confirm how this works for me?

If she already has the unlimited data plan, she will be grandfathered in, but if she doesn't, unfortunately she would have to get a plan with a data cap.
