Actually the stylus is made by Wacom. But you would expect that it wouldn't scratch the screen if Samsung had any forethought in trying to avoid replacing millions of screens. Something they could easily check when developing the device. BTW, Wacom is a long time, noted digital stylus and companion digitizing pad maker.
why would Samsung be required to replace the screen just because the S-Pen somehow scratched the screen? (unless they made the stylus out of metal or something by mistake)

Even with the Gorilla Glass, the Note 2 screen can be scratched quite easily. Samsung and Corning do not guarantee 100% scratchproof.

Be careful. I have scratches all over my screen from the S-pen. I have 5 other tablet /phones that are older without a scratch on them. News: The S-pen DOES cause scratches! I am so upset about it. I have to get the glass replaced and use the soft tips that comes with it. I don't care for the soft tips because of the drag.
