I don't know if Moto has an arbitration clause, but I am almost certain that VZW does and they could have just about any suit thrown out in favor of arbitration if they do.

Besides, as Bworley stated, you will be lucky to get a free accessory as the case would probably never go to trial and they would settle. The only winners would be the lawyers and even that would take at least a couple of years.

Contacting the BBB may be a better option for those who are that unhappy.

i called and got released from the 2 year agreement citing the fact that verizon failed to upgrade the device within the agreed upon time frame

Except for the fact that it is well known that BBB give better ratings to companies that are willing to "contribute" cash to them.

Thats possible but they helped me get my laptop returned and upgraded when Dell decieved me. BBB reports are pretty big still. Companies have special departments to handle these things. Well maybe not departments, but the response is usually escalated quickly. I say try it. If you make the effort and they blow you off, more options for trying to obtain the resolution may open up. Especially of its been documented. Its hard to prove you sent a letter, but when the BBB have it tracked in there systems, its far more visible. Show them that paper... Trail that is.

Interesting... I may have to try this. I would rather add tethering to my unlimited 4G data on the Thunderbolt and cancel the data plan on the Xoom.

And with the latest tweet out of vzw it looks like you could and it'll only be 30 for unlimited. Let is know how you do.
