For example, can you buy the phone from ebay and use it with a non unlimited data plan?

Sprint will not activate it on any other plans.

When the Sprint rep was setting up my accout with the RS rep over the phone, she specifically made sure I knew I had to be in a data plan.

Actually Sprint has a feature that can block all data connections the phone attempts to make, it is really nice on some phones that have WAP browsers like a Razr that can accidentally be launched.

But to answer the OP, unfortunately no although I think it would be a nice option if you just wanted to use it for talk and text and wifi for browsing. Not everyone can afford a data plan and they might want a nice phone.

yeah I currently have a treo and i always accidentally connect to the internet..

I guess i'll be getting that data plan .. and that dam premium charge lol
