There is a setting that you need to change to get rid of the menu bar. It's under the display section I think (my One is in the other room on the charger at the moment), but you need to change the home button behavior to swipe up for Google Now and hold home for menu, then the black bar will be gone.

Settings>Display, gestures & buttons>Buttons>home>select Swipe up for Google Now, press and Hold for menu

Make sure you have a good wifi connection. Also keep your screen on. If the screen turns off wifi my disconnect.
