At&T keeps charging me for data

I have no data for my phone but yet they still keep charging me a fee. Is there a way I can use this to get out of contract

We need to know more. If you have a smartphone subsidized under contract, you are required to have data. It's in the contract.

No it will not allow yoiu an out right away. But just call att and have data blocked. But MMS will not work any longer. (If you do not have a smartphone.)
 
"cgardnervt" is correct. You can have data blocked but you will no longer be able to send or receive MMS (picture) texts unless on wifi.

They used to try and slide $2.00 data fees on 2 of my "dumb phone" lines, saying they accessed the internet which I knew to be a lie. The "data" usage was from MMS messages and they couldn't distinguish what it was.
I'd call, complain and get the charges dropped, but it just turned out to be too much a hassle every month, something I think they count on the majority of customers doing.

You can not send MMS via WiFi. Cell data only.

This is true. AT&T doesn't allow this usually. The carrier has to have something setup on the phone for it to work.

Odd, I've never had a problem with pictures with wifi only.
Use a couple old phones as gaming devices, both have old inactive sims and a Google number. Wifi only and can send/receive no problem.

Are you in am area with mobile data but just using WiFi?

If it's a Google Voice number then what he says makes sense. GV does use WiFi data. So I stand corrected! But as far as normal cell phone numbers from the carriers its cell data only. Tmo might allow it as they allow WiFi calling? Not 100% sure! (GV sends it as an email though I think.)
