bypassing the "required" data plan

Hello fellow androiders,

I'm interested in getting a Nexus S via Bestbuy.com. But the thing is, my sibling's phone line (lets call it 0000) is eligible for an upgrade, and mine (0001) is not ready for an upgrade.

As of recently, she's purchased a new phone half a year ago (without contract extention) and said I can use her phoneline as an upgrade to get a new phone for myself.

So, I see that I can get a Nexus S under the 0000 phoneline for free, and with a "required" data plan. While my 0001 phoneline has unlimited internet access, the 0000 does not.

If I purchase the upgrade under the 0000 phoneline and select the cheapest data plan (which is $10.00) and activate the phone with my 0001 sim card, would I still be hit with the monthly $10.00 fee?

Not sure how else to explain :'(

I called T-Mobile earlier and the woman seemed kind of iffy/unsure about it. I'll call again later today and see if a different representative may know.

I was also hoping to see if anyone here would know or have experience~
