First OTA update HTC one

I just got a replacment device and I'm trying to get the first OTA update that fixed capacitive buttons and whatnot but everytime I click check for updates it says checking then disappears. I restarted my phone, anyone have any tips?

I was under the impression that new units were flashed to the updated software versions.

That is, of course, if the phone is newer than the old one.
