So after dealing with a shipment issue with VM, and continuously trying to cancel my order without any success, and now they craziest thing happens. They ship the phone to me as soon as it was available again (still cant purchase off web-site) through complaining I gained bonus minutes and $ credit on my account, and then I check my bank account and my money has been put back, and I got a free phone even though I went and bought one from best buy, im out only 70 bucks not to bad lol, and yes I did sell the phone and now I made money.

I guess Im gonna wait and see if they say something #Shrugs

I foresee a post complaining that VM robbed you and took the money back.
Also you know what you did is considered theft?
You sold a phone that you didnt pay for and acquired under false pretenses.

I think theft is pushing it. It is considered theft sure, but to send it back he'd have to actually spend money. As morally and ethically correct people will try to sound like, only a hand full of people would send the phone back. I would definitely keep it, and have with walmart and target mistakes with shippin in the past. /shrug

Actually no it would not have cost him any money at all.
YOu call up VM and say look I cancelled this order and it still got shipped.
I wasnt charged for the phone and dont want to have to pay for it at a latter date can I get a return shipping label.

They will gladly give him a return shipping label. I have had this happen with other carriers before. They want the product back so they can sell it. And they get a discount from the shipping companies so its not as expensive as if you or I ship.

Theft by deception is a felony in most states. VM could infact file a charge against him, all it takes is a combined value of 75 bucks. And seeing as how the phone is selling for 200 I would bet its safe to say it meets the minimum. The likelyness of it happening well that is different story.

Here is how its theft by deception, he ordered the phone cancelled got credit and a mistake happened and they shipped the phone anyway. Instead of refusing the phone he accepted the package. That is acknowledgement of receiving it. He then turned around and sold it for profit and never notified VM that they erroneously sent him a phone. There for he deceived them and sold stolen property.

Wrong wrong wrong, You assume that you know the details about the situation but which you do not. I received the phone first which was just a package left at my door step, then some days later the money was returned which was no fault of mine. I did not deceive anyone and I did not steal anything, they gave it back to me, if there system is to screwed up to handle small processes such as those its not my fault. Anyway I cleared it up with them Thanks

By deception lol? If anything its them deceiving him. At most they would've sent the bill to a collection agency.

lol, Since when did the androidcentral forums become the ethics committee?

I'm surprised your not banging down the white house doors......and they still 100's of millions of dollars if not billions.

Good to hear you cleared it up. But from you OP it sounded like they refunded the money BEFORE you received the phone.

NO in the op the wording made it sound like he had received the phone AFTER they issued a credit. By not returning it its theft by deception. And if he sold it and claimed to not have received it they its selling stolen property.

Really? no seriously did you really just say that?

Do you not understand how stupid you have to be to come on the internet and brag about getting a free phone and then selling it? The kid made it sound like ordered the phone cancelled because it was out of stock and then when it came in stock it auto shipped and that his money was returned BEFORE the phone shippped.

Honestly I could care less if he does or doesnt pay for the stolen phone. BUt to come on the internet and brag is as stupid. Just brag to your buddies and high five each other. Who knows maybe a VM rep reads this and decides to check into the ordeal and just to make a example out of him files charges.

I could care less about the morals of the issue.

The only thing I have to say is that a real winner would take the time to post this online though.
