Free Press: Verizon May Have Violated Spectrum Rules

This is the best reason for a delay I've heard so far. It is no coincidence that reports concerning Google wallet and Verizon surfaced yesterday, then today the device is not yet to be released. Here's the thing. Verizon might be in a little pickle on this one. If they have already purchased the devices and the accessories, they are sitting on inventory they cannot sell. I believe they have already purchased them as they are in stores. Seems like some late night legal wrangling on this issue will be what happens. That would presume Google wallet will be available, but Google's gonna have to pay for it. Then they will release a statement that says Verizon has found a fix for the problem, etc...Phone gets released.
 
Verizon's press release from yesterday looks even worse today. They are flat out lying in that press release.
 
Very strange. What I just looked up says: Consumers should be able to download and utilize any software applications, content, or services they desire.

Not being an attorney, but having been in law enforcement for more years than I want to remember, the word "should" is sometime used as 'what is to be expected.' Not like 'shall' which means it is expected. (I know all our warrants used the word 'shall' and never 'should')

However, back on subject, it says "be able to download and utilize any software applications...." I thougth I read that even if the google wallet is not on the phone, people will be able to download it. (Could be wrong, but swear I read that and what I read might have been BS by someone on a forum.)


But one thing I'm sure about, Verizon probably does little without a legal opinon.
 
Why would this translate into a Nexus delay? Just not seeing the connection.

They are not violating the agreement on the spectrum if they don't sell the phone. Verizon is not obligated to sell a phone, but any it does must conform.

So, no phone sales, no legal exposure.

If it's truly because of this Google Wallet situation, it's going to be a long road.

There's no way this can be coming up just now, verizon wouldn't be that stupid to agree to sell the phone if these issues were relevant, would they?

Ohhh, didn't actually read article/see Nexus and Google wallet were the reasons. Unless Google were to try and get a TRO or an injunction, I very much doubt VZW would self-impose a delay.

This isn't between Google and Verizon... The agreement VZW entered into around the spectrum was with the FCC. Google went to the press with the Wallet thing... And others out 2 and 2 together.

Also, Verizon would definitely self impose a delay if it felt it invited investigations of the congressional or FCC nature. Or fines. Or lawsuits....

Remember this phone isn't a game changer for them. If they never launched this they would be fine.

Maybe they didn't think it would get to this point? Maybe they thought Google would tow the line?

I'm just not seeing them delaying the announcement for it, unless they were instructed to by the feds. If they did violate, the remedy of enjoining them to allow Google Wallet would be an insta-fix.
 
So does this little snippet from the federal regulations, not to "deny, limit, or restrict the ability of their customers to use the devices and applications of their choice? mean that Verizon cannot deny me the ability to activate any device that is compatible with their network.

Can I buy a South Korean, Indian, Japanese, or Chinese phone and force Verizon to activate it on their network?
 
I also read somewhere that Google Wallet may also be blocked from being d/l, not sure if that is true since, well I don't have a G-Nex BUT, if it is true then they are further violating the rules. Remember this is the C-Block of Spectrum 700Mhz that Google chose NOT to bid on, but got the FCC to put the caveats on.

I just hope this isn't the reason for the delay.
 
If this phone works on my apartment with 4G LTE. or even at work, I don't care about the one week delay.
 
I wonder if Verizon would consider selling back the Nexus phones to Google, at prorated rate (deep-deep discount) rather then selling them out right. Google could then sell them at a subsidized price point, themselves, since they already made money off of Verizon. Google would have the LTE devices released, consumers would have devices in hand. Verizon would re-coup some of their initial investment, without selling any units (thus not violating any FCC rules) and Verizon would possibly have new customers. Is this too easy and neat, possibly but sometimes you have to brainstorm to get the ball rolling.

I hope Verizon takes a big L for trying to block Google wallet and whatever else they are trying to block. They been doing this for years to our phones that had features that we wanted but they blocked us using them. I hope they can't sell any phones locked down anymore ever.
 
Seems like a pretty big leap to conclude that this would be the reason for the delay. First, the article doesn't say anything about the delay, whatsoever. All it says is that Free Press (a consumer protection organization) is commenting that the Google Wallet block could be a violation of those rules. I highly doubt that this kind of statement from them would be enough to put a major product launch on hold.

First, the FCC would have to go through some kind of formal process and agree or disagree with such a complaint. Then if they agree, maybe they make some kind of order preventing Verizon from selling the compromised devices. But even then, Verizon would likely be able to appeal and continue selling while that happens.

It's just a big big stretch from this article to "this is the reason for the delay."

Exactly, this is part of the big picture with VZW blocking apps they don't "like".
I hope this results in more access to apps and less carrier wrangling with what they think you should be able to use.
