Galaxy gear + galaxy note 3

When I try to use s voice to reply to text messages it says to accept the disclaimer on my phone. Problem is no disclaimer pops up.. has anyone else ran into this and any ideas?

You have to use S Voice on the phone first. Remember the Gear is an extention of your phone.
