no you need data from the carrier, you can use wifi but you don't need the sim for that

ok so I went back to the OP and the answer will be no. They will not even allow you to activate the phone without a data plan in place. Doesnt matter if you turn it off. If you are using their sim and have a smartphone on their network, you have to pay for data. I believe all major carriers are like that.
You do not have to buy the unlocked version either. ATT has them for sale.

you will not be able to activate ANY smartphone on the network without paying for a data plan. no calls, no texts. You can use it for web browsing over wifi, without the sim, but that is all
