Good post, love it. My antics are along the same field, but is this about a "patent" or about "espionage?"

Wait, haha, I must have missed something. What is the connection to espionage?

You keep missing the boat, that feature was being used before Apple was granted the patent. Apple is trying to stifle the competition. Like I commented previously, Apple did not design the patent.

I think we're on the same page with regard to the oddity that the HTC One X is just now getting delayed.

But, do you have some evidence that shows that the feature was being used before 1996? If so, that'd be a pretty awesome and exciting find. From a legal standpoint, it'd be even better if the evidence was from before February 1, 1995.

So, can anyone verify that the HTC One X doesn't have the option to select one of a few actions after clicking on a phone number or any other action-linked data type?

My cousin has the One X and I texted him an email address. When he tapped at the email address link, it automatically opened a new composed email to that address in Gmail. There wasn't any menu of options that came up.

I'm curious as you seem to be somewhat knowledgeable, how does this differ from context recognition of right click menus in windows? the menus arise when you right click but if you right click on a hyper link or jpeg or plain text the menu that pops up is different(contextually). Isnt this action almost by definition what this patent patents? Wasnt this in windows 95?

So are you telling me the HTC EVO 4G LTE isn't going to have that feature of touching a phone number and it automatically adding it to my phone app, ready to dial?
If HTC follows their strategy described in the article that I linked above, then the phone should automatically perform a default function when you select a phone number. I imagine that the initial default function will be to dial the number.

Also, is Samsung limited by this too or is it only HTC?

Not sure. It looks like Apple filed a suit over the same patent against Samsung, but the case hasn't been decided.

I'll test out the phone number with him first thing tomorrow morning. I think he's asleep now. The email address test I did with him happened earlier today when the news broke out. I'll keep you guys posted.

I agree with you that it does seem to be the same thing. Perhaps the distinction is that the device has receive generic data, e.g., a series of characters in a text message, then recognize particular data types, e.g., a phone number, and then make the phone number selectable.

I'm trying to recall windows 95, but I am a bit fuzzy. In what situation are you referring to when you see a hyper link, jpeg, or plain text? Are you referring to a web browser? I think in that situation, I think that the html data file provides the instructions to the browser that specify that data type, and how it should be presented to the user. So maybe it lacks the functionality of interpreting generic data and predicting a particular action based on the data structure. There are probably other situations that I'm not thinking of though.

It probably doesn't because the claim would require Handcent to provide the phone (i.e., the input device for receiving data (the receiver?), the output device for presenting data (the display), the memory on the input device, and the processor).

This isnt a new issue...Customs problems dont just "pop" up. Odds are they have been working thru a review to prove they abided by the ITC order and one of two things happened...they got caught not abiding by it or cant easily prove they did.

Either way HTC and Sprint both had to know this was happening but it just didnt leak out until D-Day when they knew they couldnt meet shipping deadlines. If I was a betting man I would say 2nd week in June if they dont go the court order route.

Honestly I believe the ones that are here now at stores will be the first to go before a two week hold is placed. And the remaining shipment will be given a second release date. I wouldn't be surprised if Apple tries to sue HTC for the ones her now. Apple and employees and customers know this wrong but this is a stunt.

There has already been sightings of an unconfirmed IPHONE 5 surrounded in a heavy metal body so to me it's a publicity stunt. You have the latest device on the brink of their release date. Another huge device release overseas, that wants to make an appearance here in the U.S. And until you can make a decision about your damn phone that's losing in the poll of phones to have, your holding us down.

Apple is doing any and everything in its power to get customers back on there side. Summers coming and the assholes want a piece of somebody else's pie.

I talked to a rep just now and they said it was delayed for sure but they wasn't sure as of when people would get their hands on the phone so I have no ideal

Another downside to this delay: this is going to push some people's upgrade cycles back by as long as Sprint takes to finally launch. We're all hoping it won't be long, but if HTC is found to still infringe on the patent in question, all bets are off!

As much as I hope this will get resolved quickly I highly doubt it.

Remember this is our government we are talking about and they are slow as snails. Then add lawyers and court dates and we are looking at sometime in June, probably end of June.

This brings up a load of questions:

- How will Sprint handle upgrade cycles
- Will they refund peoples money or hold it for another month
- Will they delay the launch of other phones, like the S III coming in July

and as of this morning HTC Stock is sliding

Just got off the phone with employee accounts (I have an old grandfathered SERO account) and after CS spoke with a supervisor, she said that the amount of inventory is not nearly sufficient to cover pre-orders, and that as soon a customs releases the phone, pre-orders will get priority over other sales (she said that without me asking about it).
(The weird thing is she said that even with the current held up shipment they may not have had enough phones to cover all the pre-orders, but she was somewhat vague about that statement, and sounded like she was trying to remember what her supervisor had just told her, so I suspect she misspoke on that part of the statement- but it is Sprint, so who knows?!?)

I know in the grand scheme of things this is small but something needs to be done about the patent system. I for one will vote with my feet.

I have watched as Apple sued company after company. Though I didn't agree with it it never affected me. Now that you have messed with me personally I am done. My son was looking forward to this phone for months and now it will not be here for his birthday this weekend. So my daughter will be changing from the Iphone to an Android, my son's tablet will now be Android as well, and no one in my small company will be allowed to have an Iphone on our corporate account. They can choose whatever they want Windows, Android, Blackberry I really do not care but I will not be giving Apple another cent of my money.

E mails and phone calls to Apple as well join me as we take to the internet to bring down Apple once and for all(haha I kid)

This is one reason why I'll never own an iPhone--I'm over their crap. They could and would eff up a wet dream. Jerks.
