i have a question i am having to switch carrier's because i'm in the process of moving and where i'm moving to sprint don't have cell phone coverage,

i have my phone rooted and CM7 on it as a rom, will it be legal to sell the phone on ebay in its current slate, could i possibly get more money cause of the slate.?

Yes.

Probably not but that would all depend on how naive or desperate the buyer is. Realistically, no. Expect to sell for approximately the same value as non-rooted phones on craigslist.

We have a marketplace forum where established members can buy, sell and trade android related stuff. Unfortunately you do not meet those requirements (you have less than 50 posts) so you would not be able to post there and any offers to sell or buy in this forum would be considered a violation of the forum rules. Id suggest craigslist or ebay.
