okay so SDK is available, but is the ICS source code available or not?

in short...

is it closed source like Honeycomb or open source like gingerbread?

They said it was gonna be open-source back during IO. They'll release the AOSP source code along side the phone.

We'll get AOSP source when the new phone is released or shortly thereafter.
