I don't know for sure, but the manufacturer's 1 year warranty should apply regardless of the current owner.

I'm not getting my hopes up about this, but I'm optimistic.

I'm seeing post after post about people getting activation e-mails. I haven't seen one person claim one has been shipped.

Mine is "In Production" for estimated delivery of 11/21.

No but when i talked to Dell they said it will ship out on 11/18 and to me no later then 11/21. Really just trying to get paypal sell so i can place republic wireless order because they take 5- 7 days and i have to have a phone for work and already sold my nexus 5. If I find out the 18th or sooner it wont ship out i will of course refund payment. Just if I going to wait till i get to sell I have no incentive to not try and sell for highest price I can get
