need to tap S voice mic after opening

I am on 4.4.4 and haven't used S voice in a while. I double tapped my home key to bing it up and then S voice opened up but I had to tap the mic for it to begin listening to me. Why doesn't it listen once it's opened? I'm pretty sure it's supposed to do that. Anybody else have this problem or knows a fix? I tried clearing the cache and things like that

** I've noticed that if it's the first time I'm opening it up this happens. If I simply exit and keep S voice in the multitasking list it will work fine and listen when first opened, but if I remove it from multitasking the same problem occurs.
