'New' Droid X, used? Hundreds of pics on memory card, previously activated?

I bought a Droid X from one of those authorized seller places; I had lost my Droid Pro and was using a dumbphone in the meantime. I kind of intended to research the devices in store and order online, especially since they charged more in the store than Verizon's website does (or Amazon Wireless). However I succumbed to the employee's eagerness to make the sale and was kind of relieved that I wouldn't have any activation hassles, and I could walk out with it that day. So I forked over the $200 (will be getting a $50 rebate) and as he was doing all the computer stuff I was sitting next to him and could see the screen. When he scanned the ESN (or MEID or whatever) he got a popup that said that the device had previously been activated and did he wish to proceed. He did so and I figured it was maybe a technicality and that there was a good reason that a new phone would be previously activated, so I didn't say anything.

Anyway this weekend I took a picture of something and then I noticed that some girl has 200 pictures of herself on this phone and there's music saved to the memory card as well. The photos on the card date from Feb '11 back to Jan '10 so it's not the device's original card (since the pics pre-date the phone's release). I'm not outraged or anything--the phone looks new and has a screen protector on it, cool, and it's a 4gig card not a 2 like is supposed to be preinstalled--but still, am I obligated to a refurbished price? I had specifically asked if I could get a refurb and was told that they would have to order it for me since they don't carry them. Between the popup saying that this device has been previously activated and the weird memory card, what do you think?
 
:eek: Did the sales person also fail to tell you that the phone's MEID is being tracked by the NSA because of a suspected AQAP connection? OK, just kidding. But really, who knows what else is on/in the phone? I'd put it back to the seller. If you don't want to go to the trouble, I'd do a full-wipe reset on that phone.
 
The X should have a 16 gig memory card preinstalled. If you keep the phone, you should at least point this out to the retailer where you bought it.

The new Droid X's come with a 2GB memory card....not the 16GB like before. Been like that for a a few months.
 
yeah even insurance replacements come with 2gb i found this out hard way as i ordered my insurance replacement this weekend because of losing mine and because i lost it i am also losing out on 14gb of memory card space even though i paid to insure my device that i bought not how they are selling them now...lame

Yeah. You paid for a new phone, it was represented as a new phone, and you got someone else's problems and/or a hot item. And, you can get a refurb at Verizon's website for WAY less than you paid for your "new" one. Check those out so you have ammunition in discussing what they did you you when (if) you return it. The word fraud comes to mind.

I agree, if you signed a new contract and payed for device as a equipment upgrade from Verizon it wouldn't be previously used. I would take it back and deal with a Verizon store because it sounds like it doesn't benefit you to get from a 3rd party seller.
 
I would return to the seller and if they give you any hassle, contact your state's Attorney General Office.

Thanks for all the replies! So you think I should take it to a real store? Or should I see where I get with the 3rd party people?

I got creeped out that the last photo she took was on May 3rd and I purchased it May 5th. I checked the coordinates tagged to some photos and apparently she lived in Asheville NC (I have an approximate address, a range of numbers, but not the exact address), but the last photos she took trace back to a rental cabin in Boone NC. It looks like she took it, it's something like the stuff she takes pictures of. Even if this was not her device, how does a memory card travel a hundred-some miles in 2 days and walk out of a store with me? Any ideas?
