Problems with S Pen - drawing is troublesome because pen nib won't stop pushing in?

Hello sorry if this has been asked before. I recently bought a refurbished note 10.1 2014 ed. from amazon. It works great but I can't seem to draw at all with it because the pen nib keeps pushing in when I draw. Is this not the official model? I compared pictures of my pen with the official one and it looks the same but I have to put so much effort into drawing just so that I can use the right amount of pressure to draw. I can't decide if I should return the note or complain to the seller...

As long as I'm at it I appreciate if anyone has advice for good cases or screen protectors for the 10.1 2014 ed. Thanks in advance

Verify name "SAMSUNG" in on silver area at top of pen.... You may just need a new nib.... As my tablet came with 2 extra nibs...

Might consider getting new pin and just move on instead of getting in "fight" with seller....

Regarding the first reply and link from Dale M:

This is the pen for the Note 3 phone. It will not fit correctly into the slot on the tablet, even though it will work on the screen. Be sure to order a SPEN specifically made for the Note 10.1 ( 2014 edition).
There are many listed on Ebay and Amazon. Be sure it says OEM. Otherwise, again, it might not fit inside the tablet.

Actually it's not made for the Note 10.1 only. The S pen for Note Pro 12.2 is exactly the same, it fits both models with different screen sizes.
I bought dozens of this S Pen for Galaxy Note Pro 12.2 SM-P905V from Verizon and Note Pro 12.2 SM-P900 Wifi version ; it's only $2.94 each
it sits perfectly in the S Pen slot.
