Random screen sensitivity issue after 4.0.4 update

Got a replacement and the problem is even worse now. On top of that the display is shot on this replacement. I'm about to cancel my whole plan. They can't charge me a cancellation fee if they can't provide a device that works properly.

Has anyone that is stock found a fix for this issue? It's not an app that's doing this because the issue was there on the replacement that I got last week before i installed any apps. I really want to keep my Gnex and get into rooting but they keep sending me devices with bad displays. I can deal with the horrible battery life and the poor radios but this is unacceptable for a flagship device.
