Really Irked by eBay

After I purchased my EVO 4G on launch day I had no use for my Hero anymore so I decided to sell it on eBay to make a little cash. I reset the phone and upgraded it to ?clair for whoever buys it and took some pics of it and created my listing.

The phone was in awesome condition minus one thing - the paint on the Power Button was starting to chip so rather then selling it as it was I carefully remove the rest of the paint on the button. Like I said I took some pictures of the phone and you can clearly see this in all of them. In the description I stated the phone came as is and I did not offer any warranties nor would I offer any refunds.

Long story short the item (along with an 8GB MicroSD Card and a Hard Case) sold, the buyer paid, the item was shipped, and shortly after is when the crap hit the fan. The buyer sent me an email looking to get a full refund because "the power button was missing and the charging cable was cut and the wires were exposed". I responded back and stated that the button was there and worked just fine and as for the power cord, it shipped out without any nicks or cuts in it. A few hours go by and I get another reply from him and he says "You were right about the power cord, its fine. That was just lint I mistook for a cut." Are you fecking serious? You thought lint was a cut cable with wires exposed?

I responded back again apologizing and restated I would not offer a refund based off his reasonings. It's not my fault he didn't take the time to look at the images and read the description before bidding. It's like buying a used car before looking at it or reading the inspection report. This did not work for him so he submitted a complaint with eBay asking for them to step in and force the refund. He submitted his side as to why he deserved a refund and I submitted mine which stated:

"I do not feel the customer deserves a refund for this item. Instead of using the stock images of the phone provided by eBay I used an actual photo of the device so that the bidders could see the condition of it. The description clearly states that the phone comes as is and has no warranty from me and no refunds would be offered. The winning bidder failed to read the description or look at the picture provided of the phone and now wants a refund claiming I failed to accurately describe it. His main complaint is that the power button is missing, which it is not just the paint on it had been removed. If he had looked at the image he would have clearly seen this prior to bidding. Another issue he had was that the power cord was cut and wires were exposed, but later went on to say that the cord was fine and that was just lint he saw. This obviously goes to show you that his ability to inspect the item both in hand and in photo is flawed. He is using his lack of reviewing the auction as justification for a return and full refund which is not right."

I kid you not, as soon as I hit the Submit button it took me back to my Inbox and there was already a response from eBay stating they had sided with the buyer. They never once even looked at my response, but instead basically screwed me over. What makes things even worse is that according to the rep at eBay I spoke with online, they had already authorized the buyer to ship back the phone and that he had won the dispute roughly three hours prior to me sending in my side of the story. Needless to say I am beyond livid over this.

I tracked down eBays customer service number and spoke with a live person about this and he agreed it was pretty unfair and stated that the best thing I can do is when the phone comes back to take pictures or better yet video of the phone showing the power button was in fact there and working and send that to them. This would disprove the buyers initial claim and should reverse the decision and award me the win.

That's the short and skinny of it. Sorry for my rant, I just needed to vent a bit.
 
Its cool. I'll listen to your rant. Besides I'm still waiting for payment on my storm 2 that ended 3 days ago. sent an invoice and I've heard nothing. **sigh**
 
so don't refund the money, if you have a paypal account linked, unlink it. tell him you will gladly send the phone back, but he isn't getting a dime.

Wish I could have. Minutes after they favored for him I logged in to my PayPal account and they already took the money out and gave it back to him.
