Replace or keep

I have a week or 2 left before my 30 days is up. My phone works great however when I go to record video 8 out of 10 times it's fine. 2 out of 10 it says unable to record. I have to reboot phone and it works again. Should I replace the phone or just let it go until gingerbread comes out since it may be a software issue?
 
Personally I would get a new phone since the one you have is not functioning 100%. Now would be the time as you only have a couple of weeks.

Was it bought at an AT&T store? I'm worried they might have restocking fees (I don't buy at the actual stores because of this, usually only check them out there then buy elsewhere)...
 
I had a warranty replacement done outside of my 30 days. I took it to the store and they said I could either take it to the closest supplier (or something like that) or call them and they would ship me a replacement. I chose the latter, a box came in a few days, I shipped my old one back, and that was the end of it.
 
I looked on xda-dev. and this has happened to others. I don't believe it to be a hardware issue. I got it at at&t store and will not pay a 35 restocking fee for a software issue. Thanks guys
 
Just tell them its spazed and you want another one
Restocking fee applies to "returns" not exchanges
