Returning my phone for a new one?

So, since I am having MAJOR issues with battery life (as in about 3-4 hours of life with moderate use and unable to get it to charge past 90%) and I have the leaked v3 ROM, would Verizon be able to tell that I didn't just install the OTA and the problems started after that? I'm not trying to rip anyone off, I just want a phone that works. I pay $200 a month for 4 total phones through Verizon and I don't think that is too much to ask, huh?

Or, is the ROM even an issue, seeing as though the phone should be under some kind of warranty that would cover such a drastic change regardless of which ROM is installed? It was purchased in February and it just started going ape**** this past week.

For those of you who may do this more frequently than I (which is probably everyone) should I be able to swap it for a different phone or is the norm for them to make you take the same model that is defective...in my case the Eris?
 
option 1 ( sneaky) did you purchase insurance ? If so report the phone stolen ( say you left it on the table at a restaurant you returned it was gone ) or (a gang of evil looking midget bikers hit you in the knee ,you dropped your phone they rode away ) you get the idea ,they will ask for you to make a police report and pay a deductible .

option 2 (not fun at all ) the version store might swap out the handset . oh don't mention that you hacked your phone. also bring them a basket of muffins or doughnuts !
 
I had the 2.1v3 on my first Eris and I just called them said my phone was running slow and I would like a replacement. She sent me a CPO Eris within three days and this one has the same battery but the 2.1 OTA and my battery is better than before.

I would just call them and do this, and honestly my phone was running slow but also poor battery life comes from a bunch of apps (poor quality), a lot of stuff running in the background, and usage of course but I use my phone the same amount and have less apps only ones made well and my battery lasts a whole day where before it was last maybe 8 hours.

If you are having a hardware issue, you would have had it if you had not installed the leak. I doubt that anybody at VZW can tell whether you installed OTA or a leak at this point, particularly if you have the third leak, which has the same build and radio versions.

That said, of course I would hope that you are big enough to take responsibility for having done something that VZW may decide voided your warranty and pay fully if they do call you on it. You alone decided to risk that when you installed that leak.

If you do swap, you will get an Eris.
 
Look this stuff happens all the time I've swapped out numerous phones with Verizon. I am actually going to swap my Eris tomorrow. Just be polite and play dumb. If they ask if you did anything to it just say you got the update and that's when the problems started. I have noticed that I know more about android and my Eris than most of the reps in the store and I'm no programmer. Like I said just be polite and play dumb your doing nothing that anyone else hasn't done. But like doogald said you will get another Eris.
