New come in the same packaging as brand new. You can also ask when they are replacing it which one you are getting. How do you know it's new?

My P4 broke in less then 2 weeks, getting it exchanged now. New or refurbished really makes no difference. I am sure I will be getting new, but I personally dont care.
Well if it makes no difference good for you ;-) just don't go reading any of the (many many) horror stories on refurbs.....in these forums and on the web in general. Most companies just make sure a returned phone turns on, charges (usually), and the touch screen works...then factory resets it and sends it out. You're left to find out what intricate parts of these very complex devices do or don't work.
That's why many folks go through multiple refurbs to get one that works properly.
