It is hypocracy however it is one of the situations Google puts itself and its partners in when you go Open Source. You cannot patent Open Source concepts, it is not allowed. It is also one of the reasons Apple chooses to sue Samsung instead of Google as Google is easily claim and display prior art to invalidate the Apple claims and some of their patents. It is annoying that Google leaves Samsung hanging out there instead of joining in the defense, however I really don't know patent law so I don't know what is allowed and what is not...

Google could spend a bit of its coin and attack Apple's patents with their own prior art and with Motorola's patent library but so far they have been unwilling to stoop to Apple's level. Probably it has something to do with Android being just a piece of Google's business where iPhone/iPad is the majority of Apple's business.

Samsung didn't steal the "End Call" button, they made theirs more useful. EXACTLY what Apple did with their notification system.

This is what bothers me so much about this, it's become so BS general grey area nonsense. Obviously stealing a technical patent that someone else invented is wrong, but this whole design aspect is completely absurd. You can't patent the rectangle shape of the phone, you can't patent the size of the End Call button, you can't patent that instead of just seeing a phone number the contact photo displays when one calls, you can't patent the use of small square icons, you can't patent your phone having a front facing camera, etc. I mean this is really ridiculous and Apple clearly ripped off the "design aspects" of others - IT'S HUMAN NATURE. Artists do it, musicians do it, contractors do it, engineers do it, every does it. Apple, and Microsoft, has a long history of copying things, design and physical hardware (*cough* mouse and GUI from Xerox *cough*).

People are always influenced by the works of others and unfortunately there's simply no way around that other than raising human beings in a completely isolated environment, and even then the schooling would still bring outside influence to the person. Why else would Colton have coined the memorable quote, "Imitation is the sincerest form of flattery"?

Not to mention touch interface went back a long time (3M??) and if anything is cornerstone to the smartphone it is the touch interface...

Exactly, and it's funny too because Apple has sued for other companies using a "Swipe to unlock" graphical interface on the phone. Truth be told it's all the "laws" fault. This type of nitpicking patents should never have been allowed. A simple thought of, "Oh... why do we make it that you slide your finger across to unlock the phone?" should not be something patentable because it's far too simplistic. More complex methods that involve addition technology like finger print unlocking I could see, face unlocking I could see, but sliding a finger? Well what is everyone else to do, a complex tap dance to unlock their phone just cause some designer was first to think to slide their finger? Sorry, but that is plain silly.

At the end of the day though the lawyers know the more they allow this kind of silliness to go to court the more money winds up in their pockets. It's all a self generating income scheme IMO.

I'm an Apple refugee and will probably never buy another iOS product again. BUT the rectangles are rectangles argument is kind of flimsy. Just look at all the different iPhone prototypes that have been made public. Not a single one of them looks alike. Yet they're all the same shape and have the same functions.

Then compare the original Galaxy S to the iPhone at the time. EXACTLY the same. I remember seeing one for the first time, before I even knew it existed because at the time, "Android? Who cares about that crap!" At first glance, I thought it was an iPhone then I actually thought this guy had some kind of secret iPhone prototype. It's pretty blatant.
 
Uh, no. My first Galaxy S phone, the Captivate on at&t looked nothing like the iPhone. The Captivate was thinner, all black and had curved upper and lower body. I never would have mistaken them.
Apple relies on people who don't read or "live" in the tech world to buy their phones or devices due to the lack of major upgrades year upon year. My MacBook that I bought 5 years ago is in my wife's bag now because I have a low end Dell laptop that runs circles around it spec wise. As for performance, that is a different story, but we are talking hardware now, aren't we.

Put me in a room and lay hundreds of phones on a table. Cover all of the names and logos, I could still pick the iPhone out of the bunch. I owned them for 3 years (3G, 3Gs and 4). I switched to android due to the lack of hardware upgrades they should have been implementing. Retina display on the 4 was the most significant in my opinion in three years. The OS was updated, yes, but it all appeared and acted the same. Even though the're was supposed to be all of these thousands of new improvements added in year after year.

From what I was reading yesterday, the whole trial is based on past devices, as mentioned before, not the GS3, but that could still be a whole other trial on its own. I thought I saw somewhere that the Note may be involved also.

Someone also asked why Google is not helping defend Samsung in the trial and tha t is supposed to be because Google warned Samsung that they were infringing on Apple's patents and Samsung continued on their course to release the devices.

I, like others, will never buy another Apple product again. I can add them to my short list including Sony (except for their car audio products) that I am boycotting. I am even slowly trying to convert my wife away from Apple, but with over 200 apps on her iPhone, it is a uphill battle.

@icwatudidthere - I don't think it's a flimsy argument at all. Why do nearly all flat screen tvs look the same? How about microwaves, fridges, home phones, guitars, etc? All of these things and many more eventually fell into a standard shape or appearance. What shape is Samsung and other vendors supposed to be using? Where else are they supposed to put the earpiece? How about the volume rocker? All these things just make simple sense. It's not by any means ground breaking. The App Store, now THAT was ground breaking. Unfortunately you can't stop people from creating a store to sell apps just cause you did first, well maybe not first... Not sure if another company might have done something similar first.

This is not correct. Just because something is open source, does not mean you can simply copy it and call it MikeOS. :D Android is leased to manufacturers as software for their hardware. And things like the Notification Center are patentable. Which is why Google applied for the patent in 2009. And why Apple patents any and every concept they think of. They will never use 90% of their patents, but the way the system is in the U.S. it is better to patent a black rectangular piece of glass and if it gets approved, you can now sue everyone.

The Galaxy S did look similar, but phones were already headed to capacitive touch screens before the iPhone, with a rectangular shape. Take a look at the O2 XDA Flame as an example. This was still resistive touch, but you see the design similarities to the iphone. And this was out long before the iphone was ever announced.

And the grid of color icons within an OS goes back to Nokia and RIM over a decade ago. In fact, many icons that Apple use appear to be 'similar' to what Blackberry was using oh so long ago. And I do love how Apple is showing off the green 'phone' icon as though it was an original idea. Funny, I remember seeing that icon back in 2004. In fact, take a gander. All Apple did was make the circle into a square. Total rip-off. The hypocrisy of Apple! I really hope they get sued up the arse soon. They have stolen so much. Anyway, look at the bottom of this image. See that green phone icon. Hey Apple! F U!

Nobody knows what the next iPhone hardware design will be. Everything right now is rumor and rumor has been wrong every single iPhone release.
Not all the features of iOS 6 have been revealed either as some are hardware specific.
Many app stores have come and gone since Apple introduced theirs and Apples is the only one still making money. They have far more complex apps and many, many, more developers. Nobody else is even close to the iOS ecosystem right now when it comes to devices, accessories, apps, and developers.
Playstore is a mess btw and what Spotify has to do with it I don't know since they are just one of many streaming services on many devices including iOS.
There are actual numbers around these things you know so you can do better than just saying what you would like to believe is true.

I wouldn't say every single iPhone release rumor has been wrong. Look at iPhone 4S, it is still a spec bump from iPhone 4 no matter how you want to spin it.

Many app stores might have come and gone but Apple's time will also set.

Without innovation, Apple will still be stagnant and eventually people will leave.

Playstore is not a mess in my opinion. Spotify was just an example that people can get music from many other places than iTunes. iTunes' relevancy is declining.

They are just my opinion, just like yours are your opinions. :)
 
Samsung sues.

HTC sues.
Google sues and is arrogant as can be.
Microsoft sues and makes 2 to $6 per Android handset.

So following your logic you should not use any of their devices or products either.

You know... I didn't want to say anything because I just didn't want to deal with the back and forth... but she is clearly an Apple fan and while an S3 owner (and still iPhone 4S owner) clearly posts very biased towards Apple.

I try to keep my mind open. Sure Apple has done some great things, but they are more big brother-like than most worldly governments, outside of North Korea, Iran, or Russia maybe. I just cringe at their 1984 (Orwellian) based "freedom" commercial when they now lock down things more than Fort Knox. Then they use existing technology and sue everyone after they Feng Shui it.

I'm not an Apple concept/design hater, not at all - as mentioned I had an iPhone 3G for two years. They've done some nice things. I am an Apple:

Control hater
Over pricing hater
Claiming they own technology they didn't invent hater
Liar hater - their I'm a Mac / I'm a PC commercials flat out lied frequently
Dependency hater

and Authoritarian hater overall.

^^^ I'm none of those things. I have and like many Apple products. I just hate hypocrits. Apnd Apple is one of the biggest I have ever seen. I seriously want them to get slapped just to show their devout followers that they have not invented everything in the tech world. The Apple propoganda machine rivals that of the Catholic Church during the Inquisition, Nazi Germany or the Soviet Union! It's quite amazing how that get people to believe the crap they spout. I guarantee you that within a year of iOS6 going live, people will say the iPhone was the first phone to have turn by turn navigation, 3d mapping and NFC. Just watch!

Now see, that's actually an example of how phones didn't look like the iPhone! It's not the shape, it's the details. it's the chrome border surrounding piano black, the centralized button, etc. Don't forget Apple successfully blocked the emachines eOne because it looked like the original iMac. If you google it now, you'll see apart from the bondi blue and all-in-one form factor, it doesnt look as close to the iMac as the galaxy s did to the iPhone.

And I still don't buy the rectangles are rectangles argument. I'm staring right now at my Sony Bravia XBR which I don't think I've seen another TV like it with the interchangeable frame and glass surround. That most TV manufacturers choose to make a black plastic frame surrounding the screen doesn't mean it's the only way.

Anyway, I have no dog in this fight. I love my Galaxy S3. In fact I'm still giddy about it! Android has way surpassed iOS. But that first galaxy was IMHO an obvious attempt to take advantage of a competitor's design. Even Google has been rumored to have taken an "I told you so - I'm not touching this with an eight foot pole" attitude.
