Take it back and ask them to either fix or replace it. If they can't, ask to speak to the store manager. If s/he can't help you, call tech support and ask that the trouble (that's what they call a problem) be escalated. (And, unfortunately you can't really ask, that the store manager be "escalated" on the tip of someone's show.) If a tech support supervisor can't help you, ask to speak to THAT supervisor's supervisor. (The only one whose head you can't go above is Lowell McAdam's. Everyone else has someone above them.)
It's their phone, it's their problem, so it's up to them to make it work. Stop being a sheep and insist (politely) that they make the phone work or replace it with one that does. If they can't, they've breached your contract and you can (if you want to, which you probably don't) terminate with no ETF. And that's about the second most important thing to them - not allowing a customer to terminate.
While I applaud your stick it to the man attitude, the issues that he is describing are the same issues with 4.0.2 that have been floating around here for months.
Yeah, you could request a replacement Nexus, but 8/10 chances are the next one will do the same thing. The radios you currently have on your nexus are not good at swapping between 3g and 4g, they do it slowly and unreliably. This is why the rep you talked to recommended you stay on 3g only.The quickest and easiest fix would be to unlock your bootloader and flash 4.0.4 along with those radios, otherwise wait for the fabled OTA from Verizon. If requesting a replacement nexus would make you feel better about the issue you can do that too, its not gonna hurt anything.
