Verizon to charge me $35 restocking fee.

If I switch to a phone other than the Galaxy Nexus, even though it's clear from the "low signal" thread and other threads this line of phone has issues. For now, I am going to switch to another Galaxy Nexus (no fee) to see if things are better, and if not they "might be able to waive the restocking fee". What a pain in the a$$.
 
Not all the phones have issues. I have had no signal issues at all. Verizon could make the case that it is only with a number of handsets. If that is what they say, you would not be elligable to waive because they can just keep switching you out till they find one that works.
 
I'd be willing to bet that you can argue out of the restoking fee if your phone gets a weaker signal in your home than your previous phone. That's a valid reason (based on malfunction) to return it.
 
Consider it a rental fee, With there extended return plan thru the Holidays the 35.00 isn't a bad deal to try out a phone and if it doesn't suit you then you just return it or swap it out for another of a different make.

If returned though do they reset our upgrade back the way it was or are we stuck with a new 2 yr plan would be my biggest concern.

Good line of thinking. I compared 3g signal strength with my wife's Incredible this weekend, and the Nexus was consistently and considerably weaker all the time. Not to mention 4g doesn't work at all when I'm in a heavy 4g area, and wireless get's weak in places it never did with my Incredible (at home and office).
 
Update: I made some headway on the restocking fee at the VZW store today. I used signal strength comparisons in the store with other phones to make my point. He agreed with me. Which also meant we agreed swapping the phone to another Nexus probably wouldn't help me. We swapped the SIM card, and although my signal is consistently a bit worse now, we're going to give it a few days to see if things get better or to see if we get any concrete news on a potential upgrade to fix it. In the end though, he appreciated my due diligence and patience, and that that would probably go a long way in waiving the restocking fee if I do need to go to another phone.
 
My first nexus had a screen issue, swapped out and the new one is great for me. No re stock fee.
 
whoopty doo.. its $35 dollars and you are let out of your contract extension and whatever you paid for the phone..

I paid $35 restocking fee on an unopened iphone4, and $35 on an unactivated slightly touched razr.

Its nice how Verizon allows you to replace for free though.. not everyone is having signal issues (im not), so they will take care of you by swapping out your nexus.. if you dont want to stick with the nexus and just want to be done with it.. just pay $35 dollars.. you are probably spending more time argueing with them about the petty fee then its worth.. remember time is money.

Can name a line of phones that doesn't have issues when they are released?

Even Motorola a company that earned its reputation making radios has had issues with 3G and 4G LTE. Apple has also experienced its share of problems.

There were reasons this phone took so long to be released. I doubt that it was simply over Google Wallet.

I know a few people who had to swap the phone out already and the local verizon did not charge them .
 
I purchased one for myself and one for my girlfriend. I was charged for exchanging the first one for a rezound due to signal and battery, and the second one will probably get traded in too. As for them giving you a free replacement, I know the GN has a lower signal level than many other phones. You can't always cure the problem with a software patch or all phones would run full signal all the time. You can only do so much with software. If you live in a low level signal area exchanging the GN for another probably won't help. One could keep trading them in until they agree to trade it out for free. It has to cost them having to mark it as a used phone now. I will probably reluctantly trade my other GN in for the rezound soon. I really wanted to like this phone and keep it, but after putting it side by side the rezound I will probably trade it out. The rezound constantly gets about 20 dbm higher signal than my GN when in a low signal area, and that is 3G as well. I will miss the GN, it is a smooth phone and has a nice interface, but I need a good signal. If I have to pay for an exchange, then I will consider it money well spent. Better than getting suck with a phone that doesn't meet my needs for 2 years. My regret is not buying one of each, and trading in the one we didn't want.

To a point you are right, $35 in the grand scheme of things isn't much, but it's more the principle here. I bought a smartphone, that basically can't surf the web, because of a well known issue. I paid to upgrade, when I'm finding my 2 year old Incredible was 90% more reliable. So tar and feather me because I feel like I didn't get what I paid for and shouldn't have to PAY MORE to get a fully functional phone.
 
Oh, and they won't charge a fee if I swap out for another Nexus, only going to another phone - which they may not charge me for either if it comes to that.

If its a known issue that Verizon is working on with Google and Samsung, they will NOT let you out of the restocking fee. Because Verizon has acknowledged it, and because a fix is coming, you're pretty much screwed.

I bought it because I thought it would do basic things like surf the web and take pictures. That's right, tonight I was getting an error when trying to use the camera. I can understand some bugs, because to a point I knew what I was getting into. When basic functionality is crippled though, I don't have to just live with it because people on a forum think this thing is the holy grail. Bottom line is, they sell this phone right next to every other phone, without a disclaimer that it's a "developer phone" and to expect basic things like surfing the web to rarely function. So, I think I'll be leaving it, since I'm not loving it. Actually, I love the phone, just can't live with not being able to look up things on the web at crucial times.
 
Update: They did waive the restocking fee. I now have a Rezound. The facts were to obvious to overlook, considering I walked into the VZW store without even a 3g connection on my phone.
