We are screwed!

The May 18th date hasn't arrived yet. And Sprint is allowing people who pre-ordered to cancel their orders. And Sprint has said that those that decide to keep their pre-orders will still get the device before Sprint customers that didn't pre-order.

This is an ITC issue based on a previous ruling. What can people sue over?

I wasn't suggesting that Sprint will be sued, that referred to Apple. I probably should have quoted more of the previous discussion.
 
Not sure if I missed that on the news posts but can you point me to where it says Apple went to Customs and asked for the stop order?

The way I've understood this situation is that Customs is just verifying that HTC isn't in violation of a patent that the ITC ruled they were in violation of on previous devices.

That is correct. But why now? Why not a month ago when ATT was getting their devices ready for launch? Or a couple of weeks ago when Sprint first started bringing them in? It just seems a little shady, that is all. Timing is everything. I'm trying to get some info from my wife who works at DHS with a huge contingent of CBP and ICE agents. I don't know if she will get anything but I've given her the pertinent questions to ask.
 
I am not jumping on the OP's bandwagon but you do have to wonder why HTC is just now trying to get these phones shipped???

It's what's known as Just-in-Time delivery (JIT). It's a method of supply chain management that is used to reduce overall inventory costs by scheduling shipments to arrive "just-in-time" to fulfill demand.

Cui bono? It's a reasonable inference from the circumstances. The odds of customs going after HTC's flagship products without also halting other shipments (such as the One S and pre-Sense 4.0 devices) that also potentially infringe the same patents are pretty low. And if new HTC devices have been on a customs watchlist since April, how did the review units make it into the U.S. in the first place?

Apple might well be completely innocent in all this. But either way HTC and Google's lawyers are going to find out one way or another, and if it turns out Apple did instigate a frivolous customs action to harm a competitor there will be serious litigation.

It's reasonable to infer that Apple could have instigated this whole thing, but right now we don't know that as fact and a lot of people here seem very quick to blame Apple.

Based on what we know so far, I feel that it's just US Customs doing their job based on the ITC ruling.

Still, if the initial shipments of the AT&T One X were held up, I'm sure Apple would have got most of the blame their as well.

April 19 was 4 weeks ago. I'm sure there have been shipments of the devices since that date. Review units for the plethora of sites reviewing it, units for the people on The Voice, etc - they came in at some point. I'm sure ATT has received some units between April 19 and now. We would have heard about this sooner if it had happened a few weeks ago. I'm not saying Apple is directly involved in the current hold up. I don't think many people are. I blame Apple for the petty and frivolous patent suits, as well as all of the companies who engage in it, that led to this. But make no mistake, Apple started this a few years ago and with it a chain reaction of litigation by these other companies solely to mitigate Apple's barrage of lawsuits.

Like it or not, Microsoft did it the right way with Android. And quite frankly Android did it the right way with Microsoft.
 
How is this HTC or ATT or Sprints fault? Customs is only investigating because of who? Apple is at fault for the delays because of there lawsuit against HTC. Apple is trying to put pressure on these two Flagship devices because it may just be around corner before apple comes out with iPhone 5. We all know the iphone 5 will be a solid devices but in Apple's mind it has to be these phone to get regardless of all hardware or features it will get from Android devices are ready out. Apple will still push there product like it's OMG phone even those they haven been original since the first iphone or with there Siri. Apple is to blame for this and maybe even Google fore not stepping up with it's hardware problems. Whatever the phone is delayed or not and regardless who you blame will not change that fact.

Well i'm not to concerned about it. We'll get our phones by Friday or next Friday or even sometime after that. No big deal to me.

I been rocking my evo 4g for 2 years so another few weeks wont kill me :)

I'll keep my pre order and love the phone when i get it (whenever that may be) :)

I'd be mad at Apple if they were the only ones doing the suing.

not really because they can still stop american companies from selling products that may be in violation of patent law right

I agree this convo was over the top. It reminds me of the people at a restaurant that yell at a waitress for bad food (from the cook) lol

Sweet...Everyone, One shipment can be cancelled...Now if only more would off themselves, we would all have our phones sooner than later!!! Speaking of, anyone know if they shipped yet?
