i lost the old phone so I do not have its serial number or the old phone number just the account password, name and date of birth
is there a way to get the account back

You might want to try Samsung support, but it sounds like their system is doing what it's designed to do, which is to make sure you are the rightful account owner. If you contact Samsung, they may run you through a game of "20 questions" to make sure the account is yours.

Welcome to Android Central! If it's asking for phone number verification, then get a new SIM card from your carrier (which should be the same number), insert it into a new phone or a backup phone, and go from there.
