Definitely sarcasm haha. Verizon reps are well aware of the software issues but they are told to replace the phone anyways.

Call Verizon and use some of the suggestions in this thread when talking to them. try to remain calm, your goal is to get them to transfer you to tier 2 support:

Basically, tell them what you have gone through, ask them what they can do for you, don't specifically ask them for another model, etc. Hopefully, they will look up your account and see that you have been a good customer (right, no late payments?) and take care of you.
 
I haven't had to replace my Eris but I was told if I had to replace it more than 3 times verizon would offer me a phone at equal or lesser value, so unless you absolutely love the Eris I would try getting a new phone. Maybe even see if you agreed to pay a little bit up front if you could upgrade to the X or Dinc
 
Well, I got my update last weekend, seems to be a bit more speedy and have a bit less lag when I try to do things. It still isn't as responsive as I'd like it to be, however, it's better than it was after the initial 2.1 update (but still not as good as it was BEFORE).

After they offered to send me my 5th phone and the lady was rude, I got a hold of a supervisor. I'm getting the Moto Droid Friday.
