yeah, that article is like comparing apples to oranges with what we're talking about. Rooting should fall under fair use but there are plenty of clauses in the TOS that clearly prohibit circumventing tethering policies and Verizon would most likely win in the name of "protecting" their network from abuse. I still think it's silly that they claim "unlimited" data yet limit the ways you can use it. On the tiered plans, are they going to get rid of the extra add-on? If I want 2-5GB of data, it shouldn't matter where that data comes from.
I am not convinced verizons tos reflects this ruling, and there lies some confusion for people unfamiliar with android mods. I am not talking tether apps being legal, that is a very debatable subject. Rooting is legal, and that is the law that will hold ii in any suit. Again, root away folks ....your not breaking the law.
