That $175 is an extremely fair deal. Comparing to Apple, where you're paying $99 up front for the AppleCare+ and then $50 for a replacement phone, it's a nice gesture, because you don't have to get the insurance up front.
And to think there are people so stubborn that they'd rather break their phone than buy a $20 case. Must be nice when money is no object, and they just go get a new one.
Even if I was a multi-millionaire, I would use a case just because I think phones without them feel too thin and light. A case gives me some substance, and a feeling of security.
Option 1: $175 to have it replaced with a "like new" device in an unknown amount of time.
Option 2: $250 deposit, plus $175 for a "like new" device within 4-5 business days. Deposit to be returned upon receipt of damaged goods.
And to think there are people so arrogant they think they know what's best for everyone else.

As to it being "like new," at this point I highly doubt they'd have much refurbished stock at this point (ones like yours being returned are what will seed that stock, and there can't be too many cases as of yet), so you might well get a "new" one.
In either case, I recommend confirming with them what the warranty is on the replacement (e.g., is it 90 days, a year, or the balance of the original phone's warranty).

I don't think there's anyone who chooses a broken phone over a $20 case... So, obviously, no need to be a jerk about it.
