Is the battery icon part of the rom or nova launcher....I had it once before and didn't know if it was from codename

It's part of the rom "Axiom v15" and to change just go into ROM controls then battery and choose circle icon.

Do themes and and custom icons like that take a root?

Do themes and and custom icons like that take a root?

Some themes require root (flashable themes that require CWM), others dont (like, adw themes, or go launcher themes). it depends.

The icons don't require root, if you use apex or nova launcher ... you can download the icon packs, decompress them, and put them on the sd card.

then, on your homescreen, you can long press the icon, hit edit, click the picture, and then choose the new icon you want to replace it with.
