I think your phone is fine. Unless I am mistaken, this is a limitation of using a CDMA (Sprint or Verizon) network as compared to a GSM (AT&T) network.

Man, AT&T's marketing is really quite good on this topic. Because what's going on is that AT&T runs two networks: GSM and HSPA. AT&T can offer simultaneous voice and data *ONLY* in places where they offer both of those networks. If you're stuck in an area where AT&T offers only GSM, guess what: you can't do voice and data at the same time.
On Sprint and Verizon, their 3G (EVDO) network ran on top of their voice network. So you couldn't access both at the same time. Now that they're both offering a 2nd network (wimax for Sprint and LTE for Verizon) handsets that have access to that second network can do simultaneous voice and data... as long as there's coverage.
Simple answer: if your handset has access to two networks, you can do both simultaneous voice and data. This is true if the 2nd network is HSPA, wimax, LTE, or even wifi.
I can confirm, if your on 4G then you can surf while on a call. i use this feature all the time. I am surprised Sprint does not talk about this much. Its a great selling feature.
