Ridiculous verdict in Apple/Samsung case

While Apple may infringe on the patent that Google is trying to get for their Notification Bar, Google hasn't been awarded that yet and based on analysis by others, Apple may have done enough to not be in violation of what Google is actually applying for. From what I've seen so far, Apple may infringe on a very small part but again, Google doesn't have the patent yet so no one is sure how much of Google's original filing will stick.

This is where I feel that Apple goes straight to the hypocrisy line and loses credibility. They say copying is wrong but will look to justify their actions purely based on the book of patents. This is lame. It's like stealing but never getting caught then calling your friend a thief when he steals from you. If scientific research was done this way we would never cure anything.

Oh but it is I used to work for a very large pharmaceutical company you should see the money they spend in patents and patent protection. Just read up on how pfizer was able to get the patent for Viagra extended to 2019.

This whole mess isn't worth the time Samsung and Google will be fine after the dust settles.

I could see apple/other manufacturers and some touchscreen manufacturers getting multitouch gestures certified as a standard. Ones like pinch to zoom aren't going away regardless of who holds the patent, so turning them into a standard would make sure everyone that had any input in creating the software and hardware behind them were compensated.

No one can force Apple to make those standards though. Just because you and the other OEMs want it to be doesn't mean that it will be a standard. It's their patent and their IP according to the law, they can do what they please with it. To Apple that is a core feature of iDevices that sets them apart from the rest. If they wanted it to be a standard they would have proposed it as a standard.

Samsung was awarded no damages on their patents because they tried to use FRAND patents to force Apple to deal their proprietary patents. That is why Samsung got nothing. They already declared those things standards and so they cannot refuse to license them to anyone or license them under different conditions.

I was able to get 11 touch points registered on my GNex.... not gonna say how, but anyway, what is the limit?

You used your nose, didn't you!

I don't know the limit.
Just a bird's eye view of mine, I didn't research it yet, but if Google wants to pay me for it, will gladly do so.
You have to consider that most people hold the device in one hand, and pluck it with the other hand plus maybe one thumb; that it is an average human hand, not the fingers of a virtuoso pianist or expect the fingers to draw a Picasso line drawing to get the appropriate response; that the motion may last from one tiny tap to a dragged sweep or long press or twist; that all ambiguities between motions must be smoothed out; blah blah blah.

And then offer these motion events to developers to use as they see fit for their specific application. I'm not sure that a pinch/un-pinch can only be used for zooming only. It's only the obvious first choice, there may be some app that could use it -- perhaps a music player volume control, or to make it shut up when you're on the phone.

And yet my uncle imports a generic from Germany perfectly legally.

You may be right in the case of "boner" drugs, but when it comes to things like infections, cancer and the like most scientists on this side are looking to place their findings in journals of medicine so health care can continue.

If this is not the case we are all screwed. LOL.:p

Okay what about this? Is this not a 100% hypocritical situation for Apple? They are literally trying to steal the ideas off of the people making them money. It's like stealing from your employees.

Read the update in the article. Also, without seeing the patent its impossible to know if they're even remotely the same thing.

Exactly Microsoft tried to do the same stuff, look what happened to them.

Come on the image says a lot. Seriously you have to call it the way it is. The function of what is described is a total rip off and Apple was clearly trolling their own app store. Apple tries to look like a saint in court vs. Samsung yet chooses to do as they please when it suits them. Not saying they stole or screwed anyone over but the taste is a bit bitter any way you look at it.

This comment from the post makes a good point.

I think it?s more likely that the people involved in drawing up this patent simply didn?t think about the message it would send to developers. I?m sure it?s not Apple?s practice (or intention) to plunder the App Store submissions bin for new things to patent. But there remains a conflict of interest in Apple acting as the sole steward of the iOS software universe while also filing patents in areas that have long been staked out by third-party developers.

What bro? Apple doesn't rip people off! Anything they do, no matter how immoral or plagiaristic is justified and anyone who says otherwise is obviously a rabid Android Fanboy and Apple hater. Apple's patents are legit and worth defending. Anyone else's should be made FRAND or disqualified. Don't you know that Apple invented smartphones and multi-touch?
