Apple says that the external design of these phones will confuse people, and make them think it's an iPhone.

Yes, these two phones included.

And no, I'm not kidding. You can read their complaint for yourself, where the GEM and the Nexus S are both mentioned. If you think either of these is an iPhone, please say so. I promise the rest of us will point and laugh. A lot.
 
Can I just /point /laugh at Apple now? Please?

Nonsensical. Even if we don't talk design on the Nexus S, how the heck is Gingerbread identical to the iOS!?

Hardware and software trade dress claims

6) a bottom row of square icons (the ?Springboard?) set off from the other icons and that do not change as the other pages of the user interface are viewed.

The first four seem flimsy in light this..

I have never seen the F700 comparison before. I have seen people bring up the LG Prada quite a few times.
 
So according to Apple, all other smartphones are supposed to me triangle-shaped abacuses?

Yeah, the Galaxy S looks like an iPhone. And yeah, Touchwiz looks just like iOS when you open the app drawer. However, Apple, when you included the Nexus S in this lawsuit, it lost all validity.

You can bring up the Prada for the technology of capacitive touch screens, I was talking mostly about the form factor complaints Apple made in the law suit.
 
I just think apple is feeling the heat from Android devices and is trying to lash out feebly at other manufactures.
 

Also worth mentioning, according to Nilay (and he's right, I looked lol) Apple used images in their filing that are copyright of Engadget and Android Community without permission or due credit. They are stealing copyrighted material, and I certainly hope they are at least censured by a judge for it -- right before he forces them to repay the money they wasted back to California for such a ridiculous claim.
 
And Apple stole their look and feel from Symbian.

I had an SE P800 back when it was originally released in 2003.

Kind of reminds me of the good old days when Apple sued Microsoft for stealing "their" idea of a windowing operating system, Xerox countersued knowing they didn't have a case because it was too long ago when they invented the windowing operating system Apple got the idea from.
 
I will admit, my Galaxy S Vibrant has been confused for an iPhone. My Nexus S? Everyone tells me it's " a HTC" , apparently Android can only be HTC or Motorola, I think Apple got to people they don't realize that Android devices could even be made by Apple ( hell Google wouldn't sue xD). Anyways, I think Apple has a slight point on the Vibrant but not about the Nexus S and this other device, the touchwiz interface has been around longer than the iPhone( I believe, please correct me on that). Also how can you own this style of managing applications? Hell WebOS does the same thing. However, the difference between the Vibrant and the iPhone 4 is that you won't see productive widgets on an iPhone. You will see em on a Vibrant for sure, cause the home screen ISN'T THE APP DRAWER.

Wow. Really? The first one looks NOTHING like an iPhone. The second one - with the cover - is closer but still NO cigar.
 
This is a comparison between an (you know which phone and that phone which will not be named) - ok its an iphone from 2008 and an LG prada that was released in 2007 January.

Rather similar dont you think ?...looks like LG built a time machine and traveled to the future to copy the iPhone so they cold release a similar looking phone One year earlier...

(please tell me you got my sarcasm ?)


And all this time I've been wondering why Apple hasn't filed a law suit against LG.
