t-mo tubex & tethering

I was downloading some videos w/ tubex app when t-mobile sent a message to sign up for tethering wifi plan (can longer download w/ tubex). How can this be when I didn't have any computer laptop or game console connected to my phone? Does tubex violate any contract?
