If I have an app open and lock the screen. When I unlock the screening I have the usual unlock thing to drag right or left. But I also have the 3 little dots that open the extended menu. If I click the 3 dots from the lock screen it unlocks the phone without me sliding anything.

I think that depends on:
1) Which app you left running when the screen locked
and
2) If you have secured unlock or just swipe-to-unlock

If no security, I think accessing the menu button serves the same purpose as an intentional swipe.

I've only noticed it in apps that are not optimized for ICS. It seems like the app doesn't handle the menu button switchover properly, so it ends up sticking.

BUT, the fact that you can also swipe down the notification drawer on the lock screen may mean that it is intentional.

No its not secured. Just swipe to unlock. And it's happened with tapatalk and words with friends. Haven't tried it with any other apps.

It happens with PowerAmp as well. If I hit it on the slide screen, it will unlock to the app (which it would have done anyways if I unlocked it with the slider).

Luckily it doesn't do anything if you have a secure lock (pattern/pin) which I just tested.

It happens with legacy apps that still use the menu button. I'm sure it's a bug, not a feature.

I also noticed this and figured it had to be a bug. I think this is how I accidentally turn my volume back on during the day. A lot easier to unlock your phone by accident if you leave one of these apps open.
