WiFi staying on even though sleep setting is set to OFF

I just noticed that my WiFi is staying on while the phone is asleep. I checked and rechecked (and changed and change back) the settings for WiFi to be OFF whenever the phone is asleep but to no avail. Any ideas? I think this may be what has caused my battery performance to degrade ever since the JB update. By the way, I even reset the phone to factory settings and reloaded everything, but the WiFi stays on.

I have a note 2 and leave my wifi on while the phone sleeps, no abhorrent battery life for me in the month that I have had it. The note 2 runs jelly bean as well.

I never upgraded my s3 to jb, as I traded it in before the update came out, but I don't see how the wifi would be draining the battery unless it is constantly sending and receiving data.

I also have my note to set to scan for access points and there seems to be minor battery hit as well.

Some people here in the forums believe that the battery issues on the gs3 after jelly bean may be due to the gps.
