Yes it does use your data. I just chatted with vzw rep.
Your Chat Session ID is RT18955092280.

My name is Katrina, how may I assist you?
James: When downloading a ota update does that use your data?
Katrina: Hello James
Katrina: Yes, it does use your data.. We recommend doing OTA updates over wifi. :)
James: Thanks

That's what I'd surmised.

Personally, I'd believe their documented FAQ over what a rep says. :)

They do free service based texts that don't count against your text allowance, same thing with OTA's and your data allowance. Honestly, I've NEVER heard of anyone being charged overages because of an update. Can you imagine the outrage if they did?

The ONLY time you may incur data charges with an OTA is if you're roaming off Verizon's network, which is the only time their update documentation (see http://support.verizonwireless.com/support/system_update/galaxynote2.html) mentions using Wi-Fi to get the update. :)

If Google? releases Over the Air (OTA) updates for my device, will I be charged for data usage?

No, you won?t be charged for data usage on any OTA updates you receive on your device.

In my experience Verizon will take every possible opportunity to charge you (comparatively speaking) if the opportunity arises.
