Repeat issues with Evo Shift

Quick background; purchased the phone when the Evo 3D came out for my sister in June 2011. Since then, the phone had the speaker go bad within two months of purchase, to which Sprint wanted $35 to replace it with a refurb, which we did. Now, the screen has started to work intermittently and the touch panel is hit or miss. Again, back to Sprint, and another $35 to repair/refurb.

Long story short, with two issues in less than a year, is it worth my time to push Sprint to make it right? This isn't the result of damage, but component failure.

shouldnt it be under warranty? Why the $35 charge?

We don't have insurance on it of any kind, so I think the $35 is to cover the replacement order.

Apparently they had one in stock, but it was a refurb that wouldn't charge, and they had to order yet another refurb to replace the phone.
