Battery meter question

I have been having issues with my battery meter not moving since I switched out the kernel. Instead of showing me how much I use, it sits at 95% and does not move, then some 24 hours later when out of juice it just dies. It gives one low battery notification and just dies thirty seconds later. This is a minor inconvenience that I would like to fix because I don't always want to leave it on the charger out of not knowing how much battery power I have...
 
Test it with a widget to see if its the devices battery stats that aren't working properly or just the battery bar in the notification bar. If a widget works fine, it sounds like your framework-res.apk file was modified/replaced by the kernel. You can try switching to a different framework file like in the thread below to see if that works properly.

So its not just the notification bar. The Widgets I have tried all say 95% as does settings/about phone/battery info. I have since flashed the stock kernel back but that still has not made a difference.
